Orilo Terms of Service
Orilo is operated by Echotime Technology. Read our Privacy Policy for information about Google account connections and data use, or visit our public homepage.
These Terms of Service ("Terms") govern your access to and use of Orilo, the voice-first AI Host application, together with our websites and any other services that link to these Terms (collectively, the "Service") provided by Echotime Technology, a Cayman Islands exempted company ("Orilo," "we," "us," or "our").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Registration and Access
1.1 Eligibility
You must be at least 18 years old to create an account, access, or use Orilo. By creating an account or using the Service, you represent and warrant that you are 18 years of age or older. Individuals under 18 may not use the Service, even with the consent of a parent or legal guardian. We may suspend or terminate an account if we reasonably believe that the user does not meet this age requirement.
1.2 Registration
You must provide accurate and complete information when you register, and keep it up to date. You are responsible for all activity that occurs under your account, and you agree to keep your account credentials secure. Notify us immediately if you become aware of unauthorized use of your account.
1.3 Access
Subject to your compliance with these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to use the Service for your personal, non-commercial use.
2. Using the Service
2.1 Permitted use
You may use the Service only in compliance with these Terms and all applicable laws. We may make the Service available through APIs, SDKs, or software; you may use these only as expressly permitted.
2.2 Restrictions
You must not use the Service, including any connected Google APIs or Google user data, for the following activities:
- Use the Service in a way that infringes, misappropriates, or violates any person's rights.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, models, algorithms, or systems underlying the Service, except to the extent this restriction is prohibited by applicable law.
- Use the output of the Service to develop models that compete with Orilo.
- Use any automated method to extract data from the Service, including scraping, spidering, or crawling, except as expressly permitted.
- Represent that output from the Service was human-generated when it was not.
- Interfere with or disrupt the Service, including by circumventing rate limits, security features, or access restrictions.
- Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable, or that violates the rights of others.
- Use the Service to generate content that facilitates or promotes sexual exploitation of minors, real-world violence, self-harm, or other harmful activity.
- Create, obtain, or distribute AI-generated non-consensual intimate imagery (AI NCII), including sexualized images or videos of a person without their consent, or use Google APIs or Google user data to facilitate such activity.
- Connect an account you are not authorized to use, or use a connected account to send spam, phishing, or unsolicited bulk messages, or to access, change, or delete information you are not authorized to handle.
2.3 Feedback
If you send us feedback or suggestions about the Service, we may use them without any obligation to you.
3. Content
3.1 Your Content
The Service allows you to submit voice recordings, text, images, and other information (collectively, "Input"), and receive responses from your AI Host ("Output"). Input and Output are collectively referred to as "Content."
As between you and us, and to the extent permitted by law, you retain any rights you have in your Input. You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works of, and process your Input as necessary to operate, provide, maintain, and improve the Service, and to enforce our policies.
For information received from Google APIs, the Google user data restrictions and Limited Use commitments in Sections 1.4 and 1.5 of our Privacy Policy govern our use and transfer of that information and take precedence over the general Input license above. That license does not authorize general-purpose or non-personalized model training using Google user data.
3.2 Ownership of Output
Subject to your compliance with these Terms, we assign to you our right, title, and interest, if any, in the Output generated for you by the Service. This assignment does not apply to third-party materials, our pre-existing content, the Service, Host identities or voices, templates, or other materials owned or licensed by us. You are responsible for the Output, including for ensuring it does not violate any applicable law or these Terms.
3.3 Similarity of Output
Because of the nature of machine learning, Output may not be unique across users, and the Service may generate the same or similar Output for other users. Responses that are requested by and generated for other users are not considered your Output.
3.4 Accuracy
Artificial intelligence and machine learning are rapidly evolving fields. Given the probabilistic nature of the Service, use of the Service may in some situations result in Output that does not accurately reflect real people, places, or facts. When you use the Service, you understand and agree that:
- Output may not always be accurate. You should not rely on Output as your sole source of truth or as a substitute for professional advice.
- You must evaluate Output for accuracy and appropriateness for your use case, including using human review as appropriate, before using or sharing Output.
- You must not use Output relating to a person for any purpose that could have a legal or material impact on that person, such as making credit, educational, employment, housing, insurance, legal, medical, or other important decisions about them.
- The Service may provide incomplete, incorrect, or offensive Output that does not represent our views. If Output references any third-party products or services, it does not mean the third party endorses or is affiliated with Orilo.
3.5 Health, Professional Advice, and Emergencies
Orilo is not an emergency service and is not designed to provide medical, mental-health, legal, financial, or other professional services. If you are in immediate danger or experiencing an emergency, contact local emergency services.
4. Third-Party Services
The Service may integrate with or link to services provided by third parties, including sign-in providers, AI and voice-processing providers, and app-store providers. Your use of those third-party services is subject to their own terms and privacy policies. We are not responsible for third-party services or content.
4.1 Connected Google accounts
You may choose to connect Google services, such as Gmail, Google Drive, Google Calendar, Google Contacts, Google Tasks, Google Docs, Google Sheets, and Google Slides. Connecting is optional, and you control the permissions you grant on Google's consent screen. Our access to and use of Google user data is described in Section 1.5 of our Privacy Policy.
Where you grant the relevant permissions, Orilo may act in your Google account at your instruction, for example by sending emails or replies, labeling, archiving, or moving emails to trash, organizing files, or creating or updating events, contacts, tasks, documents, or spreadsheets. These actions are performed on your behalf. You are responsible for the instructions you give and for reviewing any requested confirmation before an action proceeds. Because AI Output may be inaccurate, check the recipients and content of messages and the items affected by an action. Completed actions take effect in your Google account and may not be reversible through Orilo.
You can disconnect a Google service in Orilo or revoke Orilo's access in your Google Account settings at any time. Disconnecting stops future access but does not undo completed actions. Your use of Google services remains subject to Google's terms.
5. Intellectual Property
The Service, including all software, text, images, audio, video, trademarks, service marks, and other content provided by us, excluding your Input and Output, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual-property laws. Except for the rights expressly granted in these Terms, we reserve all rights in and to the Service.
6. Termination and Suspension
You may stop using the Service at any time. You may delete your account through the Service's Settings menu.
We may suspend or terminate your access to the Service if we believe that: (a) you have breached these Terms; (b) your use poses a security risk or could harm us, our users, or third parties; (c) we are required to do so by law; or (d) we discontinue the Service. Where reasonably practicable, we will provide notice of suspension or termination, unless notice would create a security, legal, or safety risk.
Upon termination, your right to use the Service will immediately cease. Account deletion and retention of personal information will be handled as described in our Privacy Policy. Sections that by their nature should survive termination will survive.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, RELIABLE, OR SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
The limitations in this section do not apply to liability that cannot be limited under applicable law.
9. Indemnification
To the extent permitted by applicable law, you agree to indemnify us against third-party claims arising from your unlawful use of the Service, your willful misconduct, or your infringement of another person's rights.
10. Dispute Resolution
10.1 Governing Law
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the Cayman Islands, without regard to conflict-of-laws principles.
10.2 Informal Resolution
Before starting formal proceedings, you and Orilo agree to make a good-faith effort to resolve the dispute informally. You may contact us at support@orilo.live with a brief description of the issue and the relief you seek.
10.3 Courts and Mandatory Rights
Subject to any mandatory consumer-protection laws that apply to you, the courts of the Cayman Islands will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. Nothing in these Terms affects any rights or remedies that cannot be waived under the laws of your country or region of residence.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other means before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
12. App-Store Specific Terms
12.1 Apple App Store
If you download the Service from the Apple App Store, the following additional terms apply. You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the Service or its content. Your license to use the Service on any Apple device is limited to a non-transferable license to use the Service on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms. Apple has no obligation to provide maintenance or support for the Service. In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Service; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service. Apple is not responsible for addressing any claims by you or any third party relating to the Service. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
12.2 Google Play
If you download the Service from Google Play, you acknowledge that Google is not responsible for the Service or these Terms, and that Google Play's own terms govern your download and payment relationship with Google.
13. General Terms
- Entire agreement. These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without notice to you.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force.
- No waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of our right to enforce it later.
- Notices. Notices to us should be sent to support@orilo.live. Notices to you may be sent to the email address associated with your account or through the Service.
